Research On The Institution Of China’s Arbitration For Sports

Arbitration for sports is the mechanism used in sports field to settle disputes. In China, with society and economic developing, deepening on sports cause and its commercialization, rapid disputes increase urgently demands an effective and rational mechanism. Because of Sports Law of China being published late and rules still remain to be improved of how to resolve sports issues, therefore, to make the ways institutionalize is of vital and realistic significance that arbitration is used to settle issues in sports.We have done research on sports institution of America, Switzerland, Japan, and international sports organizations that offers experience and reference for our establishment of arbitration for sports. Meanwhile, in China, building the institution is provided with basis of reality and law. However, the current situation is not that optimistic where arbitration is seldom used to solve sports disputes, which inevitably leads us to fall into a passive position in international sports activities. Therefore, it has particular necessity to build the institution of arbitration for sports.On the establishment of the institution of arbitration, we should be oriented to its popularity among the people, independence, and authority; also pay attention to those problems, such as its field, role in law, and arbitration for sports disputes revolved with other countries. And we also take consideration to improvement of law, to ensure a relatively complete mechanism of arbitration for sports that consists of general procedure, simple and easy one, and the procedure used to settle disputes with other countries. Finally, considering that arbitration for sports is voluntary and popular, we need set up the judicial oversight mechanism to attain sustainable development of the institution of arbitration for sports. Then we can put the institution of arbitration for sports onto the track of socialist legal system.
