Identification And Processing System Of The Illegal Constructions

With township development in China,illegal constructions are become a toughProblem in government administration,which has threaten to not only Public safe,but alsoallocation of urban land resources and harmonious society.However,due to the lack of legaldefinition and unclear classification, the approaches to deal with the illegal constructionare not in unity, and many problems exist in the governance of the illegal construction. TheAdministrative opposite parties may lose their rights because of the onefold manner ofdealing with the illegal construction.This paper discusses the academic definition of illegal constructions, briefly reviewsthe practices of control and management on the constructions in China, makes typologicalanalysis on the concepts of illegal constructions and unapproved constructions, combs theprovisions of government files,regulative documents in law.From the angle of administrative process,this paper analyzes several reasons forpredicament in the administrative execution.The paper proposes four suggestions for theimprovement of the processing system of illegal constructions. As to the conduct ofharmonious governance,we should build up identification system and improveenforcement mechanism.
