Research On The Collaborative Governance Of Illegal Constructions In Shanghai

Illegal construction governance in Shanghai has been always handled by administrative enforcement. But the illegal buildings are still intensified. from a number of provisions about remediation of illegal structures and illegal construction in shanghai" issued in 1993, Although the relevant laws and regulations have been adjusted and updated several times. The existence of illegal construction has deeper issues- urbanization in social issues, such as housing security, legal and regulatory issues, etc. These problems are not resolved whatever administrative enforcement. This paper attempts to considered the illegal construction as a system of governance, in this governance system, Government, Departments, Businesses, NGO and Public are all as subsystems, which are separate, unique, and interdependent. To achieve the healthy functioning target, illegal construction management system requires coordination between the various subsystems and in the internal subsystems.This paper is divided into six main parts, each part of the structure of argument are as follows:The first part is an introduction section, it introduces the background and significance of the topic, describes the research status of illegal buildings at home and abroad.The second part is of the core concepts, definition and the grouping of illegal construction, and puts forward the concept of collaborative governance.The third part tells the Dilemma of illegal construction Govermance and the experience both here and abroad.The fourth part analyzes the main types of illegal construction, the characteristics of users, introduces the legal basis, status quo and the history of illegal construction management.The fifth part analyzes the non cooperation problem in governance system.The sixth part,taking the domestic and foreign experience, proposes solutions and measures with government-led and collaborative governance in the five subsystems: Government, Departments, Enterprises, Non-governmental organizations and the public.Illegal construction management is a systematic project, not overnight, Government, Departments, Enterprises, NGO and the public should collaborative operate in order to achieving the purpose of effective governance.
