A Study On Administrative Law Protection Of Vulnerable Groups In China

With the proceeding of reform and opening up, market economic system is gradually established, accompanied by a rapid development of national economy, as well as a remodeling of social structure and a dramatic change in interests pattern. During such a transitional period, interests of some social groups are damaged greatly, leading to the problem of Vulnerable Groups. What’s worse, there is a tendency of deterioration in both scale and degree, which is a severe obstacle for deepening reform and a threat to social stability and prosperity.In China, the protection of Vulnerable Groups has already become an outstanding and urgent social problem, and has attracted extensive attention from all sectors of society. However, due to the interdisciplinary nature of the definition of Vulnerable Groups and complexity in its extension, it is hard for precise location, let alone comprehensive protection. In addition, there is an ambiguity in related theoretical and practical bases, thus the administrative law that should function at the present period is often ignored, or does not attract enough attention. What’s more, the current system still has some disadvantages, plus that the sequential, transitional and connective mechanism is only a slogan and an idealization. Therefore, this problem shows a tendency of deterioration in a long period. On the basis of clearly defining Vulnerable Groups, this thesis tries to make clear the theoretical and practical bases of administrative law protection of Vulnerable Groups and come up with strategies to improve the existing system and innovate an ideal system.This thesis includes four parts. The first part gives the definition of Vulnerable Groups. Through reviewing the original definition of "Vulnerable Groups" proposed abroad and comparing related domestic definitions on the basis of interdisciplinary research, the author gives a clear definition of Vulnerable Groups. Flexible and strict standards of defining its extension are also established based on the classification of Vulnerable Groups. The second part elaborates the necessity of administrative law protection of Vulnerable Groups from perspectives of practical dominance and its advantages. The third part analyzes bases of administrative law protection of Vulnerable Groups from theoretical perspective and introduces its current situation from practical perspective. By analyzing the disadvantages, the author proposes two major measures—improving administrative payment system and establishing social assistance system. The fourth part first makes clear the basic principles and theories in joint efforts of government and society. Then the author presents his tentative reflection on the improvement of administrative payment system and the establishment of social assistance mechanism.
