Research In Legal System Of Village Banks In Our Country

Village bank is a new thing, which was born in China’s rural financial important stage of incremental reform, shoulders the important task of supporting agriculture a lot. The development of village Bank needs the guarantee of legal system and support, this paper mainly focus on the development of village Banks. In this paper, we focus on the development of village Banks, with the concept of legal system of village Banks in our country, analysis the actuality and the existing legal system, sum up the experiences of outside at the same time, from the market access, internal control and external supervision, public policy support four aspects put forward relevant opinions and Suggestions.The first part of this article is an overview of village Banks, mainly discusses the background of the emergence and development of village Banks, introduces the present situation of the rural financial supply and demand, narrates the village Banks arising from such special background. At the same time, on the legal nature of rural Banks, points out the characteristics of village Banks, development situation and the insufficiency.The second part of this article mainly discusses the constitution of legal system of village Banks in China, introduces and summarizes the existing legal system. It points out that the village Banks in our country legislation has some problems like low level, a transitional, imperfect and unreasonable shortcomings and so on. Specifically, from the market access, internal control and external supervision, public policy support of the current legal system four aspects are analyzed, the problems are pointed out.The third part of this paper is to introduce the legal system of similar outside financial institutions. Respectively introduces the legal system of similar financial institutions in developed countries including the United States, Japan, Spain,in developing countries like India, Indonesia, Bangladesh, and summarizes the successful experience of these similar financial institutions outside.The fourth part of this paper is on opinions and suggestions of how to perfect the legal system of village Banks in China. Still form market access, internal control, external supervision and public policy four aspects, put forward a series of opinions and Suggestions including continue to ease market access, strengthen internal control, strengthening the external supervision, increase public policy investment and so on.
