Based On The Prison Production Mode Under The Background Of Prison Organizational Reform

Prison production is one of the important means of reforming criminals.Chinese prisons organize criminals to produce,since the early days of the republic, it has experienced half a century,from small to large, road building,land reclamation to industrial and agricultural production, involving dozens of categories of economic structure, has raised a large number of ranges, varying scale prison companies, forming a huge prison production system.It had successfully reformed large quantities of criminals in the historical practice, creates a great deal of economic benefits. This has remedied the deficiency of the fund input of state finance of our country to a certain extent and strongly supported the prison-round development.However,because the change of the prison’s operation system is developed with era,for the long time over the past, prison production beard dual task of reforming criminal and maintaining requirements for the development of prison.Since reform and opening-up,specially with the establishment of China’s socialist market system and market economy continues to improve,the mode of prison production—"a hybrid of Prison and enterprise "is faced with problems,this kind of special operating mechanism of incorporating reforming and producing the "double" function into an organic whole, have already appeared progressively,and have restricted the improving continuously of working efficiency of the prison.So, prison production reform is put on important agenda.Prison reform should adhere to the nature of the country’s dictatorship organ, adhere to the provisions of prison law that labor should aim to criminal reform. From China’s actual, planned and purposefully gradually adjust prison policy of our country, and gradually achieve the prison production and funds gradually over by the state.At present, our prison’s function is return to the function that supervision and education reform the criminal. But, due to the dual constraints of the aim that the " criminal’s reform through labor " and state finance which is unable to realize fully, the work in prison is still a important way to transform the criminal.Based on the prison production development in China,this article author analysis the disadvantages of "a hybrid of Prison and enterprise "prison production mode in the past,tell us the prison organizational reform which the main content is "monitoring separate enterprise" is inevitable.Then based on the A prison’s prison production in Yunnan, introduce the recent prison production which has finished the prison organizational reform, including the superiority and problems, and analyzes the cause of the problems, through learning from foreign prison production mode, put forward the countermeasures solving the prison production problems.
