Hunan Prison Prison System Reform Pro Blems And Countermeasures Of The Ente Rprise

The key issue of prison system reform is to separate the prison functions from the prison enterprise management. With this task accomplished, the reorganization and reconstruction of prison enterprise will be a tremendous change in the prison system reform.With the beginning of Huan Prison system reform in August 2005, Hunan Prison Administration Agency separated the institutions with the functions of manufacturing operation from the prison, and formed the Hunan Wanan Co. Ltd, which is under the direct supervision of Hunan Prison Administration Agency. All Prisons separated their manufacturing factories and formed the wholly owned subsidiaries of Hunan Wanan Co. Ltd. accordingly. According the reform plan, All the institution and staff will be assigned to the prison enterprise; and the operation funds, including the funds for the administration, reformation of prisoners, prisoners livings, and services fee, etc, will fitted into the public finance budget, full paid by government. The prison operation funds and the salaries of prison police will have nothing to do with the prison enterprise management, which should conform to the corporate governance norms.After the 10-years reform, Hunan prison system accomplished the aim of "full public finance, separation from the enterprise from the prison, separation from the income from the expenditure, and operation normally". However, there are still some problems:1. staff cannot divided thoroughly, the management of prison enterprise are still prison police; 2. Although there is no more historical burden, the prison enterprises are faced the pressure of instability of worker staff; 3. Prison enterprises do not operated independently, the prison enterprise and the prison should be coordinated in the level of administration; 4. The nature of prison enterprise is still vague, the separation enterprise from prison is only formally; 5. prison enterprise cannot r.esolve the problem of endogenous development; 6. Prison enterprise’s economic functions is weakening while the stabilization function is more and more important.To resolve the problem of unfinished reform of Hunan prison enterprise, we should clearly define its role in the law of upper level, and the Hunan Prison Administration Agency develop the prison enterprise realistically. As to the problem of development, this article suggests several methods, including the choice of the industry development direction, reform of salary system, improvement of coordination of prison and enterprise, establishment of prison enterprise culture, etc. After the reform accomplished, the economic functions of prison enterprise will become an important impetus to advance the scientific prison work, and the reformation functions will be improved through the strengthening of its economic function.
