In today’s society, with the expansion of economy, politics and military globalizationcontinuously, terrorist actions also show tendency of globalization, so people in theinternational society are suffered from them. In this case, it has become theinternational social focus of contemporary to fight against international terrorism.At the time of fighting against terrorism from international society, some problemshave been emerged, which are not only simulating terrorism further, but also gain thesuspicion of violating other countries’ sovereignty and abusing human rights.Although we have to admit that international terrorism has brought great obstacles tothe development of normal politics, economy and cultures for international society,international anti-terrorism actions should adhere to the principles and norms ofinternational law strictly.This article is divided into six parts. The first part mainly gives a brief overview onprevious anti-terrorism. The second part analyzes anti-terrorism on crossing theborder. Recently many countries state the anti-terrorism problems on crossing theborder in the legislation. Cross-border terrorism practice also happened from time totime, such as Osama bin laden was shot dead by American soldiers. This article treatsthree aspects, the principle of national sovereignty and right of self-defense, as thepoint cut. It analyzes the problem on cross-border anti-terrorism. The third partanalyzes authorization on the use of force.Recently the views of implied authorizationhave been arisen on it. Some countries regard the implied authorization fromU. N. Security Council as an excuse and attack the so-called terrorists who hide in acountry without permission or notification from a country. This article analyzesinternational law of the view of the UNSC implied authorization, which is from thepoints on the UNSC legal privileges, the principle of minimizing the use of force andthe principle of unanimity. The fourth part analyzes protection of human rights fromterrorist suspects in the anti-terrorism. First, I will introduce the legislation ofinternational society concerning about restricting “terrorist suspects”. Then byanalyzing the international law existed in “Extraordinary Rendition” and“The Special Court-Martial”, I will discuss restrictions and protection of the rights for“terrorist suspects” under the anti-terrorism background. The fifth part analyzes rightof privacy protection for citizens. First, I will introduce that the legislation concerningabout international society and restricting right of privacy for citizens in recent years. Next, by analyzing the problem of the international law existed in “Prism”and “NakedInspection”. I will discuss restriction and protection on the right of privacy for citizens.The six part analyzes the problem existed in the international anti-terrorism legislationand makes the outlook for the future of international society on anti-terrorismlegislation and practice.
