Study On The Management Of Foreign Marriage Registration In Jiangxi Province

In the context where the global economic globalization develops rapidly and the China's reform and opening-up deepens,the exchange between China and foreign countries increases and people change their opinion and attitude towards Chineseforeign marriage due to the rapid economic development.As a way to change living environment,marriage with foreigners satisfies individual's wish for exotic lives and intensifies and strengthens relation between regions.With the increase of Chineseforeign marriages and families,the service demands diversify,and unavoidably new challenges are brought to the conventional marriage registration management.Meanwhile,solving such issues and eliminating these contradictions are of realistic importance to promote healthy development of Chinese-foreign marriage,bring innovation to social management systems and maintain harmonious social development.Currently,China's researches on Chinese-foreign marriage registration management still focus on social analysis of immigration caused by Chinese-foreign marriage,or solely on juridical logic and law works,and there are few researches from perspectives of public management and public services.This paper will apply theories on public management to proactively find solutions to and proposes reasonable suggestions to problems faced in Jiangxi Provincial Chinese-foreign marriage registration management which are common in all Chinese-foreign marriage registration so to contribute to the improvement of Chinese-foreign marriage registration management through in-depth analysis on the current status of Jiangxi's Chinese-foreign marriage registration management by means of statistical analysis,comparison and interviews.The paper is basically organized in the structure of introduction,body and conclusion in seven chapters.Chapter 1 is the introduction.The author organizes his way of thinking in this paper in a standardized way that the paper introduces the research context and meaning as well as the reasons of choose such a topic and summarizes foreign and domestic research status,research approaches and methods and new ideas in the paper.Chapter 2 is about related concepts and basic theories where terminologies on marriage registration are defined,applied new basic theories on public services and management are interpreted,and the author is researching solutions to the problems by classifying governmental function on public service and involvement of more social organizations in public services.Meanwhile,the author compares the legal regulations,divorce by agreement and departments responsible for marriage registration,stating the differences on Chinese and foreign marriage registration management systems,which provide a micro reference for improvement of our Chinese-foreign marriage registration system.This chapter also introduces the main setting modes of our Chinese-foreign marriage registration authorities.It has been a mainstream mode to have Chinese-foreign marriage centrally registered in provincial level authorities on civil affairs and such mode plays a positive role on improving registration level,showcasing our national image and guarantee legal interests of parties involved.Chapter 3 introduces the current status of Jiangxi's Chinese-foreign marriage registration management,which covers historic changes to Jiangxi's Chinese-foreign marriage registration management that like the Chinese-foreign marriage registration management in all other province,Jiangxi restricted marriage between Chinese and foreigners in the early years of New China,and liberated policies on Chinese-foreign marriage after the policies on reform and opening-up were implemented.In the 21 century,to fully ensure freedom of Chinese-foreign marriage,Jiangxi began to manage Chinese-foreign marriage and Chinese marriage in a common way.As changes to concepts of Chinese-foreign marriage registration,the setting of Jiangxi's Chinese-foreign marriage registration authorities also began to manage such registration from a centralized way instead of the former decentralized way.Jiangxi Province is committed to providing legal registration and sincere services in Chineseforeign marriage registration management by carrying out standardized construction to Chinese-foreign marriage registration authorities which provides related parties with solemn and warm registration places,implementing a free-of-charge marriage registration system,providing many conveniences and benefits to the people which makes the management and service level of Chinese-foreign marriage registration and external image of Jiangxi in relation to Chinese-foreign marriage registration continuously.Chapter 4 introduces the general conditions and analysis on causes of Jiangxi's Cross border marriage registration.A lot of data are collected from Jiangxi's Cross border marriage registration database for analyzing the Cross border marriage development characteristics by means of horizontal and vertical comparison.The results show that most of such marriages are Chinese women marriage to overseas men and mixed marriage with annually decreased marriage registration number,annually increased divorce rates,increased number of mixed marriages and decreased marriage with Taiwanese.This chapter emphasizes the main causes to continuous increase of Jiangxi's mixed marriage which are economic development,frequent overseas exchanges and active illegal transnational matchmaking agencies and explains why transformation to marriage with Taiwanese will be historically inevitable for the development of Taiwan and the mainland.Chapter 5 introduces problems and causes of such problems in Jiangxi's Cross border marriage registration management,which assorts regulatory difficulties of illegal matchmaking agencies,difficulties in managing marital status and in verifying overseas references,instability of mixed marriage and unhealthy marriage with Taiwanese,analyzes the in-depth causes of such problems which are not sound enough policies to manage matchmaking agencies,blocked connections between laws in Taiwan and the mainland,insufficient restraint of divorce registration and unfavorable information interconnection between departments.Chapter 6 introduces approaches to Jiangxi's Cross border marriage registration management.Based on the realities,the author thinks it is possible to improve Cross border marriage registration management from seven aspects.First,enhance public awareness on marriage laws and guide the public to shape a healthy idea on Cross border marriage through enhanced Cross border marriage registration management;second,establish a coordination mechanism to punish illegal transnational matchmaking agencies and related departments shall corporate to investigate,fight against and punish such agencies;third,establish a mechanism to retrieve and access foreign documents and improve related legal documents;forth,related departments in Taiwan and the mainland shall strengthen communication and consultation to improve registration systems for marriage with Taiwanese;fifth,reform divorce registration procedures for marriage with the person from overseas and additionally set the links of divorce appointment and public notification of divorce agreement;sixth,enhance information sharing between departments to improve marital status management;seventh,introduce social forces to perform marriage registration expansion services.Chapter 7 is conclusion.This chapter gives a summary tothe body of the paper and concludes that it is necessary to intensify works in relation to review of Chineseforeign marriage registration,information sharing between departments,promotion of marriage related laws and regulations,marriage customs and new marriage trends and such works will certainly drive the provincial Chinese-foreign marriage registration to a new height.The author combines his own experiences from practices in the paper and hope this paper will be helpful to drive improvement to the Chinese-foreign marriage management methods in our province and our country,to realize a practical,accurate and effective management of Chinese-foreign marriage management and to bring out more suggestions to improve the Chinese-foreign marriage management in our country.
