Research On Building Compulsory Liability System Of Food Safety In Our Country

Now, China’s food security situation is worrisome, liability insurance should play its role. Based on the game outcome between more parties and the nature of compulsory liability system of food safety in the market mechanism, the compulsory liability system of food safety must be imposed. So the author thinks that China should amend Food Safety Law, draw up Regulation on Food Safety Responsibility Compulsory Insurance of the People’s Republic of China and well-designed system, in order to carry out the compulsory liability system of food safety quickly and play its role well. This is a new effective path to improve China’s food security situation.Chapter Ⅰ introduce the background and significance.Chapter Ⅱ analysis and view the status quo of the food safety liability insurance. From food safety responsibility and liability insurance theory, clarify the concept and significance of food safety liability insurance; explore the condition and problems of the implementation of China’s food safety liability insurance.Chapter Ⅲ demonstrate the need for enforcing food safety responsibility compulsory insurance by strong arm, analysis the insurance market realities demand and regulate that the legal system of insurance system from theory of economic law.Chapter Ⅳ explore the feasibility of implementing the food safety responsibility compulsory insurance, from the domestic implementation of the feasibility of the insurance, and the status of implementing other compulsory liability insurance like compulsory traffic accident liability insurance as well as reference revelation of the foreign product liability insurance, to analysis and demonstration.Chapter V propose to the specific ideas of building China’s food safety compulsory liability insurance system. First, system functional orientation and values are defined—a new path to ensure food safety; second, proposed to build a new path from the legal system basis and practical promotion steps; finally, illustrates the system such as operating principle, the scope of responsibility, exclusion, floating rate, third part unconditional right of claim.
