Research On Responsibility Allocation Between The Travel Agent And Perform Helper

With the vigorous development of China’s tourism industry, tourism disputes between tourists and travel agency are also increasing year by year. Group travel which connects tourists’eating, accommodation, transportation, sightseeing and shopping, involves many subjects of tourism, which leading to the deputes between tourists and travel agency complicated.The travel agency, as one of the subjects of tourism, is responsible for arranging and coordinating tour activities and plays a crucial role in tourists’travel. On the one hand,it signs a contract with tourists to provide package tourism services, on the other hand, it also uses many perform helpers to provide various specific services. Therefore, the travel agency is the key factor in travel deputes relationships, and the responsibility assignment between the travel agency and the specific perform helper is also the key to resolve disputes.The first part of thesis introduces the current situation of the responsibility assignment between the travel agency and the perform helper in judicial adjudication, and points out the importance of defining the responsibility of the travel agency between the perform helper.The second part of thesis analyzes the cause of the problems which the previous paragraph referred, analyzes the problems of responsibility allocation between the travel agent and the perform helper under the present tourism laws and regulations.The third part of thesis studies the relationships between the travel agency and the perform helper, and classifies the perform helper into general perform helper and special perform helper.On the basis of the above analysis, the forth part of thesis proposes the plan of responsibility allocation between the travel agency and the perform helper. The first half part of this thesis’ forth part expounds the theory that why the travel agency should be responsible for its perform helper’s perform and the obligation of the travel agency and the perform helper. The second half part of this thesis’forth part analyzes the travel agency and the perform helper’s responsibilities in different situations.The fifth part is a conclusion, briefly summarizing all the arguments of this thesis.
