" Rule by custom " as the traditional border policy is a national policy on thehistory of each of the feudal dynasties of rulers in accordance with the history andculture of various ethnic groups, customs and way of life for generations ofproduction implemented minority areas of governance. Each dynasty governed attachgreat importance to the differences between different ethnic groups, and thus theactual formulation and implementation of national laws for all ethnic groups, in orderto consolidate their dominance. After the establishment of the Qing rulers regime,because the vast territory of the unprecedented, making the control of the Qing rulersethnic relations more attention than the previous generation ruler of the nation ofunprecedented regional management enhancements. Therefore, from a legal point ofthis paper analyzes "because of customs and rule ’policy is reflected in how thegovernance side of the Qing legal practice, through research legislation,administrative building, the administration of justice, etc., and from the normative,the relationship between central government and local government, the centripetalforce and improve these aspects of its coercive power of the central government ’sminority discourse, reflect the " rule by custom " policies into practice the rule oflaw, and it really showed in terms of national governance superiority.Will also hopeto find how to better deal with the practice of the ethnic problems of policies intonational law in the method, for our today’s national legal system construction toprovide a little reference.
