Study On The Governance Function Of Folk Custom From The Perspective Of Rural Construction Under The Rule Of Law

Folk customs have special status in the rural societies governance in ethnic areas.In the field of regulating people’s rights and obligations relationship,and resolving each others’ interests conflicts or interests attribution,they have gained people’s inner conviction and universal recognition.Therefore folk customs,together with the law enacted by the state,are the basic norms of human society and have the functions of supplementing the state legal system,guiding values and maintaining rural stability in rural societies.These functions are still indispensable in the construction of a modern country under the rule by law.The legal system construction in the countryside is an important strategic basis for comprehensively advancing the rule by law strategy of our country.The countryside’s legal system construction is based on the ground of countryside,so it must be carried out in the countryside as the soil for the task.However,in the process of building the rule by law,folk customs also encountered multiple difficulties,mainly due to the tension between folk customs and villager autonomy,the lack of interaction between folk customs and the state system,and the problem that bad folk customs restricting the development of the village under the rule by law.In this regard,t it is important to explore the ways to improve the governance function of folk customs in the construction of the countryside under the rule by law,and adjusts the governance function of folk customs in the construction of rule by law in the countryside from various aspects,including promoting the good connection between the governance function of folk customs and villagers autonomy;enhancing the effective interaction between the governance function of folk customs and the national legal system,and regulating the governance function of folk customs through the rule by law,which undoubtedly have important theoretical significance and practical value for the successful advancement of the rule by law construction.
