The Protection Of The Children’s Right Ir China By The Administrative Law

In recent years, incidents involving the violation of children’s rights are heard frequently, which heats up the concern towards the protection of children’s right. Though in our country, judicial protection targeted to guard children from crimes which violate the Criminal Law is relatively complete, still it is reduced to a narrow field. The protection of children’s right in a broader sense still relies on the Administrative Law. This thesis starts from analyzing the definition and development of children’s right which explicates the change from the ancient conception of children protection to nowadays protection of children’s right. Besides, theories which involve the protection of children as a vulnerable group are included in this part This thesis, with authentic cases as example, focuses on the subsistence right, education right and right to be protected from abuse. By analyzing the relevant provisions of the "Children Rights Treaty" and China’s "Protection Law For Juvenile", the author discusses the inefficiency existed in our country’s protection to children’s right with the intention to offer suggestions to improve it. Chapter Ⅳ of this thesis is the focus, combined with the vulnerable group protection related theory. Children, as a vulnerable group, rely on the positive support of public laws to protect their right. The necessity and urgency of the protection from the Administrative Law perspective is discussed in this part. Specific improvement thinking and measures are brought up on the basis of Chapter Ⅲ which discuss the problems in lawmaking, practice and ideology.
