A Study Of Children’s Participation Right

Children’s participation right is one of child’s rights and be specified on the Convention on the rights of the child and Minor protection law of the people’s republic of china. It basic connotation is that children have the right to participate in the affairs affecting their own interests. Family is the child main place to grow up and socialize. The coexistence of children dependence and children autonomy causes children’s participation morphology diversification.Hart’s ladder of theory provides important theoretical support for evaluating children’s participation. In order to convenient for evaluating situation in family, this paper simplifies Hart’s 8 levels for six levels.This paper survey the present situation of middle school students’ participation in family by questionnaire in shijiazhuang. The investigator distributed 878 questionnaires(both students and parents), and 812 taken back. This paper descriptively analysis statistical data by SPSS software.The Introduction introduces background and purpose of this research, also explains design and execution of the questionnaire and the basic information of the sample. This paper consists of five parts except the introduction:Part one introduces children and adults legal knowledge about children’s participation in three aspects, which their understanding of the relevant laws, the cognition of child to participate in and the cognition of the child’s right of participation. The data shows that they lack of legal knowledge, about sixty percent of them had never heard of “chhildren’s participation”. And their right consciousness is weak.Only about ten children and adults said they understood this right better or very well.The second part analyses the present situation of children’s participation within family through child personal aspect, child’s school work, child to participate in family life, which shows that the characteristics of this situation is multilevel coexistence. Because of different things and different ages, children’s participation in different levels. Besides, different ages and parents support have different degree of participation in the same affairs of family.The third part investigates evaluation of children and adults about carrying out children’s participation in family. The evaluation refers to four angles, namely about the present situation of children’s participation, the value of children’s participation, the influence factors of achieving children’s participation and the ensuring policy of children’s participation.Children and adults relatively satisfied with the present situation. Most attitude are general,someone have optimistic attitude. They more emphasize on value of the right about children own development. The most attention is the help of the parents and school and the training of children’s participation awareness.The fourth part summarizes the expectations and suggestions of children and adults writing in the open questions about carrying out children’s participation in family. Children wanted to achieve independence, autonomy, even generation equality. Adults emphasized on more communication between adults and children. Both sides are proposed.The fifth part analysis the above data,involing the contents of the total of 12 sections.It summarizes the present situation of shijiazhuang city children’s participation in an all-round way. It mainly related to the lack of legal knowledge and rights awareness, the characteristics of multilevel coexistence. Adults master the standard of judging children’s independent ability.Children and adults have high enthusiasm and a positive attitude. According to the present situation, this paper puts forward three suggestions. First, in order to deepen the understanding of the public, the most important thing is disseminating and popularizing the children’s participation. Second, we should actively explore the evaluation mechanism of children’s participation, which adapt to the social and cultural traditional in our country. This will improve the maneuverability of the investigation and evaluation of children’s participation.Third, standardization of relevant legislation.To perfect relevant legislation shape children’s participation.It will provide reliable legal protection for the realization of children’s participation.
