Study On The International Law Of The Children’s Right To Development

Children are the future and the master of human beings,so the protection on children has been a concern for discussing.The children’s right is a fundamental right to do activities including the right to develop.Children has always been the vulnerable group, so the infringement and deprivation of their rights still occurs.It is a necessity to strengthen the right on children,which means the protection on human’s future and strength.Among the measures, legislation,by means of international society and government is the most effective and directive ways,which is the require of UN Convention on the Rights of the Child and also the legal backing to improve for protecting the children.In other words, it is necessary and essential to guarantee the burden on the contractors’responsibility as well as legal obligation when lawbreaking occurs.Aiming at the relevant issues on the children’s right to development, this paper discusses the development and its legal protection,combining analysis the deficiencies and the current situations,and puts forward constructive suggestions and proposals. By doing this, an expectation could come true as soon as possible.The paper consists of three parts, including the foreword, the main body and the concluding remarks, at the same time, the main body of this paper consists of four parts.The first part is summarized in to the general description of the children’s right to development,in which part the concept, subject and the essence are included.Its special nature of children requires objectivity, scientificity and normative in protection. By making generalizations,comprehensive understanding of the children’s right to development is combined with complicated laws and regulations.lt is possible to form the essential and content of the children’s right to development in general application.The second part includes the main points of the right to development,i.e., the concrete rights corresponding to the abstract concept,including five right and its connotation. The children’s right to development in international outline is the third part of this paper.In this part, the sources in the International law, the general principle, the the required duty on the contractors listed in laws and regulation will be discussed. Therefore,the protection on the children’s right to develop could be under the strict supervision, forming an environment ruling by law.The last part discusses the children’s right to development and its protection in China. The reality that the children’s right to development is violated and deprived still occurs, so it is necessary to improve the current situation by law construction.This part puts forward constructive suggestions on improving the protection, according to the major problems and disadvantages in China.
