From the accountability of the Wenchuan earthquake donations to the new wave of anti-corruption campaign, from the Wukan incident to walking protest, such as these outbreaks of social mass events are more and more in this century. On the one hand, we are pleased to see the rise of citizen consciousness and social power, on the other hand, we should be worry about the crisis of legitimacy. Facing the increasingly serious crisis of legitimacy, we should nether due all the problem to the pain of social transformation, nor maintenance of stability blindly, but to review the changes of social structure and culture, and find out who we are and the development of our culture. Then we can not lose ourselves during the social transformation. The modernization transformation means to use the advanced or high-tech means to preserve our nation’s most precious thing, but not uprooted our culture and transplants the foreign culture. Preservation of traditional culture is not simply to cherish the memory of the past, more is better to continue to the future. The civil society is the development of Western cultural system, what can maintain and develop human rights, foster the power of democracy. After all, civil society is a product of Western culture system, which with Chinese society insurmountable cultural divide. Therefore we should the innovative transition ways, looking for common elements of a successful civilization, and illuminating the road of freedom and democracy ahead. Several times in Chinese history to the modern civil society transformation efforts ended in failure, ignoring China’s unique and complex social and historical experience, formed the western history of civil society as a common experience to guide China’s social transition, inevitably face culture and system of double block. Because of this, putting forward to Confucian civil society will have the important meaning. According to the internal logic structure of Confucian civil society, the legitimacy foundation of Confucian civil society can be divided into on behalf of the Confucian "heaven" the wisdom of the universe "orthodoxy" legitimacy, on behalf of the history and culture of "learning system" legitimacy and representative of the legitimacy of the trinity "politics", of which Confucius as the spirit of the Chinese culture foundation of adhering to the "Dao", by the independent free palm university of "learning system", by the democratically elected representative organ as the power of the "politics" organization, the total which checks and balances of mutual cooperation. On this basis, the possibility of Confucian civil society reality or transfer the focus of society are discussed, including the Confucian political resources and the democratic system, the benefit coordination mechanism to link, the coupling of Confucian economic thought and market liberalization, and then to the reshaping of modern citizen ethics Confucian cultural resources. In order to solve the possible problems, need from the power structure, ethics, customs, legal system, education system, charity fruitful reform, Confucian civil society can truly make it was supposed to grow germinate on the land. At the same time, we should also see civil society is only one possibility for the development of social transformation, and the Confucianism is not fully meet all the requirements for free constitutionalism extension practice in modern society, still need to refer to outstanding elements of western culture, but the Confucianism in the social transformation to provide multiple role is inclusive and open public space should not be neglected.
