Research On Juvenile Criminal Judicial Organ

Recently, in Chongqing a10-years-old girl maltreats a baby, it causes the public to think deeply. The girl should be naive, but she kicked the baby cruelly,and even throwed it from the tall building, which kinds of violence, the behaviour of ignoring lifes make us hair stand on end. Now the juvenile criminal case is increasing, the nature of the case is more terrible, and even beyond uns imagination. The research for Juvenile criminal judicial organ is very imperative.The first Juvenile Court has been established1984in Shanghai Changning, which is the milestone of the Chinese Juvenile court’s establishment and reform. Since then juvenile justice system set up in China, the research of juvenile trial starts from theory to practice.In next30years, the juvenile justice system is explored and developped continuely, it goes through establishment, consolidation and finally get all-round development, even aross the low. After the continuous innovation, the juvenile trial collegial panel has expanded, including juvenile comprehensive trial, juvenile case designation of jurisdiction and so on. Moreove, with the changing of juvenile judicial organ,a series of distictive working systems have been established, including education in review, social investigation, the comprehensive administration,round-table takls, a moratiorium and so on.The creation of this series of working systems is based on the characteristics of minors. At the trial minors are given more care and protection. Practices show that it has a positive effect.However, with the development of era and the progress of scientice and technology, the number of juvenile delinquency is increasing, and even appears the organized and violence crime. Because of the complexity, particularity and characteristic of minors, it is necessary to reform and innovate the juvenile justice system. The establishment of Minors Court becomes the tide of history. This article focuses on the characterics of minors, extraterritorial juvenile criminal judicial system and the status of China’s juvenile judicial organ. By the analysis we believe that, it is requisite to establish Minors Court and it will be realized in the near future.
