| With the Free Trade Zone was inaugurated in Shanghai last year, the "Free Trade Zone" become an upsurge in China, many governments are in the process of applying for establishing a free trade zone. People begin to pay close attention to the regional economic development pattern, and focus on relevant national policies. As a new round of the pilot project of reform and opening up, the establishment of the Shanghai free trade zone is of great significance, opening a new mode of special zone economic development in our country, and bringing a new chance to Chinese reform. The establishment of the free trade zone, which indicates that our way to develop foreign trade and regional economy is no longer limited to the bonded area and bonded harbor area, but further enhanced and increased the level of internationally accepted free trade zone. Shanghai Free Trade Zone, however, as a new economic development model in China, is in its infancy, and the development of many aspects needs further exploration and improvement. How to build the free trade zone? This is an issue that needed to be addressed in promoting economic transformation in the new period.Free Trade Zone (FTZ) as a kind of important form to promote trade liberalization and the development of regional economy, after several hundred years of development, is still alive and plays an important role in a country or region’s economic and social development. Free Trade Zone, also called free zone or tariff free zone, which refers to a country or region may carry out special open policy and be exempted from tariff in a certain range on its territory, in order to realize the goal of using import and export trade or processing and manufacturing to dive regional economic growth. For centuries, the free trade zone in their respective development process have got some success in varying degrees, and accumulated a wealth of experience. Especially the United States, they called it as "Foreign Trade Zones". Not only owns the largest number, but also a good development, all these should thank to its scientific management system and the unique open policy. Therefore, in the construction of our own free trade zone, we should not be on the grounds that it must be emphasized on Chinese characteristics, and ignore the general common in the development of free trade zone. We should be properly learn from the experience of other countries, and then on the basis of innovation, make our free trade zone keep up with the pace of era, at the same time, create our own features and styles.Now, the development of free trade zone in Shanghai is "crossing rivers via stone tangibility", as a pilot reform, there will be a lot of contradictory place with the old system and bold innovation is needed. In the process, it may inevitably appear all sorts of problems, which needs the decision makers to make appropriate decisions and solve the problems. Of the problems in the construction and development of free trade zone, according to the development of the situation, some changes and innovation policy should be made to solve the existing problems. For this aspect, the experience of American Foreign Trade Zone (FTZ) is a very good reference. The American FTZ has developed for several decades, although someone doubts that its construction experience may be out of fashion, it is also advancing with the times and policies may change with variation of national conditions to adapt to the current development situation. Therefore, for China’s current construction and development of the free trade zone, it still have certain reference significance.This article provides an overview of the development of China and American’s FTZs, analyzes the main content and superiority of the U.S. foreign trade zone regime. It clarifies the necessity and feasibility for us to reference U.S. FTZ experience. Based on this, the writer propose some suggestions to learn from U.S. FTZ experience. Apart from the introduction and conclusion, the article is divided into four parts:Introduction:It mainly introduces the purpose and practical significance of this paper. In the building boom of the Free Trade Zones in our country, it is of great significance to explore the roads to develop free trade zone for the newly established Shanghai Free Trade Zone and the future FTZs. After decades of development, U.S.foreign trade zone regime gradually grow into perfect and is of certain significance for the development of China FTA.Part I:An Overview of describing the development of Chinese and American FTZ. First, an introduction of the concept of foreign trade zone and free trade area, and the difference between them. Second, an outline of the development status and its characters of American’s FTZ. Third, an outline of the development status of China’s FTZ.Part Ⅱ:An Introduction of U.S. foreign trade zone regime and its superiority. First, an overview of the U.S.FTZ management system, regulation system and the subzone regime. Then, an analysis of the superiority from management system, entry and exit mechanisms, legislative protection and incentives.Part III:Analysis of the necessity and feasibility for us to reference U.S.FTZ.Part IV:propose suggestions from three aspects. First, in terms of legal protection, to improve the legislation. Secondly, in terms of the management system, innovative the management model. Finally, in terms of preferential policies, to provide more policy support. This paper aims to draw on experience in building the U.S.FTZ, and make recommendations for the construction of FTZ in our country.Conclusion:This paper introduces the development of the United States and China FTZ, analyzes American foreign trade zone system and its superiority, combined with the development requirements of China’s free trade zone, put some reference suggestion from the aspects of legal protection, management system, preferential policies. |
