Research On The Duty Crime Detection Power

Duty Crime, which is a top, intelligent, multinational, complicated crime, has the characteristics of concealment, professionalism and group work. Thus the investigation job is rather challenging with four difficulties:to judge, to break through, to obtain evidence and to fix the evidence, which is an antagonistic contradiction between the law and the power as well as the fundamental interests and local interests. Therefore, it is of great significance to build an investigation team of strong professional quality, of good integrity awareness, with high technology and fast response speed. At present there are theoretical opinions about the development and application of the Investigation Ability at Duty Crime, meanwhile different requirements in practice. On the basis of the concept and the specific characteristic of the Investigation Ability at Duty Crime, this thesis is to reclassify and rebuild the contents, and to further enrich the research and to provide more guidance for improving the capacity to deal with duty crime investigation. The Investigation Abilities to cope with duty crime are classified into levels. For example, the first level is Individual Investigation Ability and Organization Guarantee Ability, which can carry on the division of the second and third level. Correspondingly, the factors of affecting and restricting detection ability can also be divided into individual factors and organizational factors. Most importantly, the application of the investigation ability is the key, so the thesis provides feasible countermeasure and ways to promote the investigation ability.This thesis is made up of introduction, text body and conclusion. The text body consists of four parts.The first part is a discussion about the difference between the investigation ability and other criminal investigation ability. To begin with the comparison of the concepts of investigation, duty crime investigation, detection capability, analyze the special characteristic and then present the requirements of Duty Crime Investigation Ability, which is different from other crime investigation.The second part is about the reclassification and the reconstruction of the Investigation Ability at Duty Crime, which is the focus of this thesis. On the basis of the current main theories about the investigation ability at Duty Crime and practice experience in work, the author analyzes and reclassifies the investigation ability needed in the current situation against corruption. The author thinks that the first level should be the individual investigation ability and the organization guarantee, and the second level should be the basic quality, the ability to discover crime, the ability to expose crime and the ability to prove the crime; and the basic quality should be divided into political quality, professional quality, psychological quality, and physical quality and so on.The third part mainly discusses the restrictions and the influencing factors of Duty Crime investigation ability, that is, individual factors and organizational guarantee.The last part mainly discusses the concrete application of Duty Crime Investigation Ability. This is the most valuable contents in this paper. Combined with the division of duty crime investigation ability in theory, and the practice experience in work, feasible countermeasure and ways to promote the investigation ability are put forward.
