| In2013on the implementation of the new points added on the provision of technicalinvestigation measures, but the implementation of the new criminal procedure law fortechnical investigation measures while a certain regulation, but also a lot of deficiencies,especially in the review process during the implementation of technical investigationmeasures and relief system, supervision mechanism on without a detailed plan, lead tonowhere in the judicial practice. As the technology measure is becoming more and morewidely used, to establish perfect the supervision mechanism of technical investigationactivities is the top priority.In this paper, from the legal provisions of technical investigation measures, this paperexpounds the definition of technical investigation measures, analysis of the deficiencies onthe new criminal procedural law and the necessity of supervision and investigationmeasures of technology, and the measures for technical investigation supervision system incurrent judicial practice some beneficial exploration are expounded. The author throughthe supervision of other countries for reference system, implementation principle andrelated relief system, expounds how to set out from the situation of our country, explore toset up the technical investigation measures of supervision system suitable to our nationalcondition. For the main body of technical investigation measures supervision should be thecharacteristic of legal system in China, as by procuratorial organs. Finally, the authorcombined with practical experience and foreign judicial system, to build our countrytechnical measures, this paper expounds in detail the procuratorial supervision mechanismillustrates the principle of supervision mechanism should be put forward planning andrelated relief system of procuratorial supervision system and ideas. |
