The Reform Of The Police And The Investigating And Prosecuting Apparatus Configuration Research Investigation Stage Authority

The relationship between the police and investigating and prosecuting apparatus in the pre-trial procedure to exercise their respective powers of the relationship.Whether the allocation of authority in the police relations is reasonable and directly affects the fairness and efficiency of the whole criminal procedure.Since The fourth plenary session of the eighteenth,the general direction of the reform of the trial-centered litigation system has been established.On October 10,2016,the Supreme People's Court,the Supreme People's Procuratorate,the Ministry of Public Security,the Ministry of National Security,the Ministry of Justice Jointly issued "on the promotion of the trial as the center of the criminal proceedings system reform",which China to build a reasonable allocation of police and police laid a good foundation.Therefore,based on the actual work of the author,this paper analyzes the problems in the practice of the prosecution in our country.Based on the national conditions of our country,we will adhere to the spirit of "trial-centered" reform,build a new police and investigating and prosecuting apparatus relationship,and further optimize Litigation structure and litigation procedure,the author analyzes and reforms the power allocation of the police in China during the investigation stage,demonstrates the feasibility of the procuratorial guidance investigation,and puts forward some reform and optimization plan to the existing problems of the procuratorial guidance investigation mode,Principle and flexibility to deal with the contradictions between China's police and investigating and prosecuting apparatus relations,and strive to adapt to China's current "trial-centered" criminal litigation system reform needs.
