Reserch On Current State And Countermeasures Of Illegal Imegration Crime In Yanbian Area

Currently, illegal emigration crime all over the world is on the rise and has become a common problem for both China and other countries. Prevention of illegal emigration crime is important to the economic and social stability of a country, as well as to inter-national communication and maintenance of territorial sovereignty. With the development of technologies, smugglers are using various ingenious ways to steal into other countries. Therefore, it has been very urgent to prevent illegal emigration crime. It is significant to keep pace with current illegal emigration crime with regard to legislation and law enforcement in order to carry out the work of preventing illegal emigration crime smoothly.This paper, through regarding current state of illegal emigration crime in Yanbian area as research the research sample, has tried to analyzed the current state, characteristics and reasons of illegal emigration crime in Yanbian area. After that, a conclusion and summarization was conducted with a view to attaining methods for preventing illegal emigration crime in Yanbian area and providing beneficiary reference for preventing and fighting against illegal emigration crime in Yanbian area.In the first part of this paper, the purposes and significance of studying illegal emigration crime in Yanbian area was elaborated and the current research state on illegal emigration crime in the academic circle was stated. Moreover, statement that the research has been conducted by regarding illegal emigration crime in Yanbian area from2003to2012was made. Upon that, empiricism research approach was applied and numerous data were applied as the theoretical foundation.In the second part, the theoretical concept of illegal emigration crime was stated. Firstly, the concept of illegal emigration was elaborated; secondly, the concept of illegal emigration crime was illustrated; finally, the scale of illegal emigration, along with the origin, target countries, means and other features of illegal emigration, were analyzed through combining with the current state of illegal emigration crime in China.In the third part, the history of illegal emigration activities in Yanbian area was elaborated and the amounts, number of involved people, criminal sanctions and other aspects of illegal emigration crime in Yanbian area in the past ten years were introduced. After that, A conclusion was attained, that is:the illegal emigration crime in Yanbian area in recent years has declined sharply when compared with that in2004and2005; nevertheless, the illegal emigration crime was on the rise in the most recent three years. In addition, the harm of the illegal emigration crime to the society, households, diplomatic relations and other aspects of Yanbian area was stated.In the fourth part, an analysis on documents of illegal emigration crime in Yanbian area in recent years was conducted; after that, the common types, characteristics and reasons of illegal emigration crime in Yanbian area were stated; finally, a conclusion that the most common type is organizing and transferring other people to illegally cross the territorial border was made. Most illegal emigration criminals in Yanbian areas are men of the Korean nationality at ages between30and50; among foreigners, Korean people are taking up the biggest proportion; due to geographical reasons, most illegal emigration criminals in Yanbian area have crossed the border by crossing the river.In the fifth part, punishment strategies and criminal policies on illegal emigration crime in both China and other countries were analyzed. Through introducing relevant legislation and policies on preventing illegal emigration crime in China and combining with relevant laws in the United States, France, German and Japan, this part has concluded that China should refer to above-mentioned countries with regard to prevention strategies and content of legislation. In the sixth part, an effort to come up with suggestions for preventing illegal emigration crime in Yanbian area was made. In general, the suggestions include:perfect legislation on illegal emigration crime by the country; improve the law enforcement of public security organs in Yanbian area, establish and perfect the legal publicity system, strengthen the fighting against illegal emigration crime and cooperate with other countries to prevent illegal emigration crime according to the special circumstances of Yanbian area.
