Illegal emigration, a phenomenon of illegal transnational floating, has become the fastest increasing crime of smuggling people, and is regarded by the United Nations as one of the 17 biggest multinational organized crimes. Illegal emigration is not a problem that only China has, but a worldly trouble that puzzles every country and can not be avoided. The emergence and development of illegal emigration has profound economic elements, complicated international background and special multinational characteristic. Since the mankind comes into a new thousand year, the question of Chinese illegal emigration, which takes place mainly in the districts along the coast in Fujian province, draws the eyes of the world and the worry of the nations, and again the 911 event strengthens the influence of illegal emigration, as a non-traditional security factor, to the international society. Now every country in the world pays high attention on the illegal emigration and actively takes measures to solve this problem.This thesis first studies the situation of modern Chinese illegal emigration, especially analyses in detail the history, the feature the sequent and the reason of Chinese illegal emigration, and introduces what measures our country takes to govern it, what result we get, and the limitations of related polices. Then the thesis ascertains the migration governing practice of the United States and developed countries of the European Union, and tries to find out ways helpful for China to prevent and govern the illegal emigration movement. At last, in seven respects such as strengthening supervision of legislative body and administrative body in government, enhancing international cooperation, and increasing economic level, the author raises some proposals for China to govern illegal emigration.
