The latest criminal procedural law specifies the mandatory medical proceeding of the mentally ill with no criminal responsibility, this special procedure played an important role in the protection of public safety and social order maintains. But the existing law is not sounded, Some of the provisions are too ambiguous to operate, especially in the right of relief, the exercise of supervision and the period of medical regular assessment. All these insufficients bring about that it is difficult to start the program and it is also hard to operate it. And it also has some bad influence on the protection of human right, the law did not mention that if we should give the mental patients which have responsibility for their crime some mendical care, and that is not fair. When we put these people in prison, they may have a recurrence of the old illness, that is not safe. And when they are released, they may attact other people, that will harm the public security. In the other side, if we did not give them enough medical care that is a kind of deprivation of human rights.Through this article we can analysis some inadequacy of the law and put forward some suggestions to complete our country’s medical procedures of the psychosis criminal.This paper contains three chapters1, The development of compulsory medical procedures of the mentlly ill in our country.2, The shortcomings of the mandatory mendical proceeding in our country3, make some suggestions to complete the law...
