Study On The Legal Issues Of Strategic Environmental Impact Assessment

Strategic environmental impact assessment system is the environmental impact assessment method used in the legislation, policies, plans, programs, etc. at different levels of a system, which is intended to comment on legislation, policies, plans, programs, etc., to arrive at a comprehensive, system, the results of the scientific evaluation, the final form of a written report and used in government decision-making. China’s existing legislation and foreign-related legislation is still relatively large obstacles and limitations, the relevant implementation rules have not been introduced, the relevant operating specifications have not been clear, in order to fully implement the strategic environmental impact assessment system, there are many difficulties unpredictable. We know that the strategic environmental impact assessment system in the promotion and implementation of the process will encounter many difficulties and obstacles, this work can not be anxious in the battle for power. Therefore, this study tried by domestic and foreign strategic environmental impact assessment analysis of the legal system, respectively from the legislative, judicial, law enforcement point of view can be summed up our lessons, combined with our existing situation, made several recommendations of drawing on the experience.
