A Study On Legal System Of Water Rights Trading Supervision In China

Water is one of the most common substances on earth, it plays an important role inthe evolution of life. It is the most important part of the organism, and it’s also animportant resource of all life. With the increase of population and the development ofeconomic society, water resources allocation is imbalance of supply and demand. Inorder to realize water resources optimal allocation and improve water use efficiency,more and more country start to accept water right trading theory, carrying out waterrights trading system. But after introducing water right trading, conflict betweencommercial interests and public interests is increasing, transaction order is seriouslydamaged. The water rights trading market is not an isolated entity, its establishment anddevelopment need a series of measures. Therefore, purpose on water rights trading cango with a swing, it needs to be supervised. Also establishing and perfecting the legalsystem of water rights trading regulation is important to the construction of water rightsystem in our country. By building a supervision mechanism of water right transaction,can regulate trade behavior and provide good protection for the operation of the waterrights trading. To begin with, talk about water rights reading supervision’s change anddevelopment from ancient to modern. By introducing the current water rights tradingcases and combining with the related legal systems, further analyze our presentoperation in water rights trading regulation, and point out the existing problems.The third part is studying on foreign legal system of water rights tradingsupervision and their experience. As America, Chile, their water rights and water market construction started earlier, having established a relatively perfect water right systemand water right transaction management system. In his part, analyze foreign water rightstrading cases, policy background and legal system in detail, and summarize theenlightenment and reference to our country accordingly.The fourth part offers specific details on how to build the legal system of our waterrights trading supervision. Firstly, put forward legal principles, including equality andvoluntary, fairness and efficiency, environmental protection and sustainabledevelopment, combination of government regulation and market mechanism. Then,from a legal perspective to give advice on perfect water right trading supervision.
