The Economic Law's Idea Of The Whole Social Benefit

The economic law is the law that safeguards the whole social benefit. As soon as the whole social benefit appeared, the economic law appeared. The whole social benefit is the new benefit form that the whole society is the benefit owner, it' s different from public benefits and has complicate relations with individual benefits. As a new law system, the economic law' s legislation, enforcement and judicial mechanism all infiltrate the idea of protecting the whole social benefit. The mechanism of the whole social benefit' s integration, enforcement and relief also determine the appearance of whole function mechanism of the economic law. Besides the preface and conclusion, this paper is divided into four chapters to discuss the economic law' s idea of the whole social benefit.The first chapter discusses the meaning of the economic law' s idea of the whole social benefit. Beginning with the difference of ideas of the economic law and civil law, I bring up the economic law' s idea of the whole social benefit and then make the positivism analyse, analysing how the several branches of the economic law behave the economic law' s idea of the whole social benefit, so I take the conclusion that the economic law is the law which safeguards the whole social benefit. On the basic of chapter 1, this paper' s chapter 2, 3 and 4 successively discuss the whole social benefit' s mechanism of integration formation, enforcing protection and relieving with judicatory, and further bring forward the economic law' s legislation, enforcement and judicial mechanism. So I explain the economic law' s idea of the whole social benefit on two levels of intensive spirit and exterior express.There' re 50,000 words in the paper.
