Study On Legal Issues Of China’s Construction Industry Labor Safety Regulatory

The construction industry is a labor-intensive industry with high risk in labor safety. Although china’s labor-safety supervision and management department and social organizations supervise labor safety in the construction industry, the construction safety accidents has not been effectively curbed. By the use of descriptive statistical analysis of57construction work accident cases released by newspapers and published by Chinalawinfo, the author tries to identify security major risk behaviors and factors resulting in the construction safety accidents, and finds out construction labor security management confusion under the regulatory supervision system, migrant workers’poor knowledge of labor safety and legal awareness, and poor safety supervision and government regulation, and so on. Insufficient emphasis on labor safety and protection ideas, unclear regulatory responsibilities between the construction regulatory authorities, labor safety regulatory information asymmetry, unreasonable labor safety and technical education and training system and low implementation effect of accountability system of subject of legal responsibility have led to the problem the growth of the construction of production units in that the construction enterprises perfunctorily comply with or do not comply with security obligations in order to improve economic efficiency which leads to labor safety accidents. In order to give full play to labor safety regulation systems and reduce labor safety accidents, the author suggest that scientific authority and responsibilities allocation between production safety supervision and administration department and building and construction authority, labor safety education and training system improvement, legal incentive system of construction entity units and its leaders adopting safety precautions, disclosure system of illegal act information of construction entity units, enforcement efficiency of the safety production responsibility system of legal subjects including construction entity units and its leader, chief government officials of supervision department and the establishment of construction enterprise responsibility credit system are effective ways to cope with the main problems refered in the construction work safety supervision.
