Research On The Administration Of Migrant Workers’ Salary Arrears By Labor Security Supervisory Organs

At present, Chinese society is in high speed development and transition. It is such a crucial period that must guide on industrial relations correctly. Therefore, the government continuously strengthen labor legislation and set up the labor security supervisory organs authorized by law to protect the legal rights and interests of laborers.In labor relations, laborers are in a weak position. But in today’s tight labor market, the weak position of laborer is more apparent. So labor security supervisory organs which is the manager of social relations and the identity of the social interests of balance should use the public power to prevent illegal behavior of employers in order to protect the legal rights and interests of laborers and achieve a harmonious labor relations.With the development of economy and society, gradually appeared a kind of special groups of workers- "migrant workers". They are emerging as a new type of labor force in the process of our modernization and urbanization. Migrant workers are still registered in the country. Some work in the city in not farming season, and some work for long-term employment. As migrant workers, whose identity has been ambiguous, their labor relationship in the field of construction has always been the focus of controversy. And a large number of migrant workers do unpaid work which lead to make visit, such as group’s visit to the excesses. In recent years, more and more problems and petition about wage arrears for migrant workers in specific groups and in a large area of the outbreak have become unavoidable social problems. Therefore, labor security supervisory organs is developing as an important way for government to help migrant claim back wages, and its function and effect are increasingly becoming the focus of attention.Visible, the administration of labor security supervisory organs in the constructionof the rule of law, in particular the governance problem of wage arrears for migrant workers has played an irreplaceable role. However, does the labor security supervisory organs carry the social responsibility? Living up to its monitoring role? Playing its proper value and easing social conflicts? What kind of difficulties does it face when performing at the wage arrears for migrant workers? These issues are also the subject of research which have been discussing by a lot of experts and scholars. In fact, at present our country labor security supervision still exist many problems. After a review of relevant articles and books, I realized the research of the labor security supervision include law, sociology and administration. It is a comprehensive and marginalized issue.Especially on how does labor security supervisory organs solve the problem of wages arrears for migrant workers in the field construction, scholars’ study is not sufficient,and mostly to make advice and suggestions from law to the system. Therefore, I intend to discuss the problems and feasible suggestions about the administration of migrant workers’ salary arrears by labor security supervisory organs in order to improve our labor security supervision system.
