Research On Case Registration Publicity System Of Court

Judicial justice is the lifeline of judicial trial. However, justice should not only been realized, but in a way people can see. The18th National Congress of the Chinese Communist Party and the Third Plenary Session of the18th Central Committee of the Chinese Communist Party emphasize that impelling judicial justice should further deepen judicial system reformation, impelling the publicity and standardization of judicial power operation and let jurisdiction operate in the sunlight. Without case registration, without justice, and case registration publicity is the origin of justice publicity. At present, the incomplete legal system of case registration publicity in China and certain existent obstructive factors in practice lead to certain existent deficiencies of case registration publicity. The dissertation starts from basic theoretical problems of case registration publicity in China and discusses the deficiencies of current legal system of case registration publicity, based on defining practical meanings of case registration publicity. The dissertation applies empirical analysis to analyze the existent problems in aspects such as guidance thoughts, basic ideas, procedure insufficiencies and supervision security of current case registration publicity. At the same time, the dissertation provides the suggestion that following the guidance thought requirements of "the three first" strictly and impelling the legislation ranking promotion of case registration publicity. The National People’s Congress should further complete basic security system of case registration publicity based on litigation instruction center and define the content, exception, method and procedure of case registration publicity, providing the suggestion of structuring and completing supervision security system of case registration publicity. Through this research, the author hopes to impel the depth of justice publicity reformation sourcing from case registration publicity, improve judicial efficiency, promote judicial justice, increase justice public credibility and further realize effective unity of legal effects and social effects.
