Recently, with the fastly development of our economy, the real estate business has entered into the eraof rapidly growth. However, the rising prices of house can not be met the more and more ordinary citizens.As the saying goes “food is God to people, house is safe to human”, housing is a crucial question of thepeople’s livelihood matters, but the housing prices has become unbearable pains for a lot of low-incomepersons, at this time, the limited propertyroom appeared, it becomes the last straw for many city dwellers tosolve the housing problem, once the limited propertyroom appeared, it develops rapidly, although thenational policies more than once prohibit its building and selling, but this phenomenon cannot be abolished.On one hand, the limited propertyroom is built on collective land, does not comply with the relevantprovisions of law and judged to be illegal; on the other hand, the limited propertyroom plays a role as theprotected house, can meet the needs of urban residents who can not afford the house. Since the1990s,limited propertyroom has continued to grow and develop, which solve many housing problem. Therefore,the limited propertyroom concerns a lot of stakeholders, it should be cautious to treat this matter, if not, itmay be create social stability problems.The article is try to analyze the concept, commonalities of the limited propertyroom, in order to makeclear that the nature of the limited propertyroom is the house which is built on the collective land and soldto the buyer who is not the member of this cooperative enterprise, there are several commonalities about it,such as located in urban fringe areas, illegal acquisition of the land, can not be transacted as normal.Through the analysis of the roots of the system, society and economy of the limited propertyroom, analyzethe series of causes of this phenomenon. The article also concerns the legal risks of the limitedpropertyroom, include the risk of the developers and buyers. On this foundation, combined with theexisting Chinese laws, regulations and policies, propose the countermeasures to solve this problem. In solving the limited propertyroom matters, we should follow the principles of equality, prohibition andgrooming, classification and disposal, keeping social stability and sustainable development. On the basisof stare these principles, the author proposed that we should improve the relevant laws and regulations,according to the oriented-policies, deepen the reforms of the land, perfect the housing security system, etc,and also point out the specific treatments to the stock of the limited propertyroom.
