Study On The Function Of Anti-monopoly Law To Narrow The Gap Between The Rich And The Poor

In the year2013, China’s Gini coefficient is0.473, faced with greater gap between the poor and the rich. One important factor contributing to the gap is monopoly. The anti-monopoly law as the basic legal system against monopolies and protection of competition has the function of filling and leveling up the social disparity. Its functions include the following three areas, supporting small and medium enterprises, protecting consumers, and supporting worker.In terms of supporting small and medium enterprises, the Anti-monopoly Law embodies its support for small and medium-sized enterprises on monopoly agreement, abuse of market dominant position and the concentration of general regulation. In addition, the Anti-monopoly Law shows its special support about small and medium enterprises’ monopoly agreements and the concentration of exemption which small and medium enterprises are going to participate.In the area of consumer protection, the Anti-monopoly Law on consumer protection includes both indirect protection and immediate protection. Indirect protection through the maintenance of fair and free competition protects consumers’ right to choose and their right to have fair trade. Direct protection form of The anti-monopoly law takes the protection of consumers’ interest as one of its objectives and avoids the increased cost of consumers by regulating monopoly, takes consumers’ interest as the exemption standards of monopolistic behavior.In terms of supporting workers, the mainly function of the anti-monopoly law is indirect protection. That is to provide the opportunities of employment by supporting small and medium enterprises and to reduce laborers’ risk of dismissal, wage changes through regulating the business operators. Besides, the Anti-monopoly Law also has the possibility to provide direct protection to the workers by banning the monopoly agreement about fixed wages or limited highest wages standard and forbidding business operators depress wages through the abuse of market dominant position.Back to China’s anti-monopoly law, adequate release of the Anti-monopoly Law has the function of filling the wealth gap and this function should be optimized from the legislation and the implement of the Anti-monopoly Law. In legislation, we should enhance legal clarity provisions, refine the small and medium enterprises exemption provisions, increase wages regulation of monopoly. In implement, we should strengthen the popularization and competition advocacy of the Anti-monopoly Law, allocate the Public law enforcement reasonably and perfect the private execution system.
