China has a long history and its glorious national culture distinguishes itfrom other nations in the world. However, the process of globalization may harmnational culture and it is necessary to protect national culture to maintain nationalsubjectivity. The legislation in other countries and some international conventionsprovide basis in comparative law for national culture protection. This dissertationstudy on some legal issues on administrative protection with the following parts:firstly, the author reviews the current situation about national culture protection,and maintains that there are some disadvantages in protection measure, mode andintensity. Second, this dissertation researches on the experience of administrativeprotection for national culture in other countries. Japan and South Korea aretreated as typical cases and the experience in these countries should be learned.The last part put forward some suggestions on administrative protection fornational culture. This part maintains that the rule of law principle should be themain principle and governmental power should be limited. Public participationrule should also be abided by to improve the mechanism of administrativeprotection for national culture.
