Study On The Development Of Intellectual Property Commission Management In China

The intellectual property system of Chinese has been developed; the emergenceof intellectual property commission management promotes the development ofintellectual property. Several differences with intellectual property agency andintellectual property entrusted, a mode of intellectual property entrusted managementfirst in Beijing Zhongguancun conducted a pilot. After the related enterprises take inintellectual property commission management, each company in Zhongguancunintellectual property application and authorization increased significantly. TheIncreasing in the amount of knowledge property rights directly reflects the technicalof the knowledge and the extensively using of technology promotes the acceleratedinnovation. Therefore, the using of intellectual property commission managementmode makes technology innovation form a virtuous cycle, to promote thedevelopment of Chinese economy.However, Chinese intellectual property commission management is still in theprimary stage, there are some problems exist. System design, operational efficiency,achieves the channel. First of all, there are three external resistances in thedevelopment of managed services. First, the adaptability of large number of mediumcompanies managed service is obviously not enough, and70%of Chinese enterpriseis SMEs., and Small and medium-sized enterprises occupy the weak position in theeconomic capacity and the intellectual property rights transformation ability. Thereintellectual property protection consciousness and the decampments are not strong;this will be the biggest challenge of intellectual property commission managementencountered in China’s development in the future. Second, the government policydoes not provide enough support, but also lack of corresponding laws and regulationsto standardize the system development, what lead to intellectual property escrowservice industry access threshold is too low, the managed service provider dragonsand fishes jumbled together, unstable quality of service. third, the serious informationasymmetry between service providers and customers in a managed service, the servicecapacity, service level and service quality can not directly display in front ofcustomers, leading to the existence of huge credit barrier appears between institutionsand the managed client companies. On the other hand, on the managed services, thereare a lot of problems to be solved in terms of service content hosting services, hostingservices positioning the role of self managed way, design, which makes the present a lot of managed services can not meet the needs of the customers.Improve the intellectual property trust system although not just responsibility ofintellectual property service provider, also can not completely liability to thegovernment or intellectual property commission management customers.According to the reality in China, the author tries to study on the bottlenecks inthe intellectual property escrow service development and puts forward somesuggestions, in order to promote the smooth implementation of Chinese intellectualproperty rights commission system. The authors proposed that we can learn from theconcept--"three spiral" which put forward by scholar Tu Jun、Wu Guisheng. Threeparty--government, managed services, managed client enterprises should worktogether, guide the promotion of intellectual commission property managed in China.We can improve the service ability in strengthen the relevant system construction,improving the capacity of trustee service and expanding the hosting service channels.
