Research On The Problem Of Discipline Inspection Commission And Supervisory Commission As One Office

In November 2016,the reform of the supervision system started at Beijing,Shanxi Province and Zhejiang Province.According to the provisions of the Pilot Program on the Reform of the National Supervision System in Beijing,Shanxi Province,and Zhejiang Province issued by the Central Committee of the Communist Party of China,the Supervisory Commission and the Disciplinary Commission at all levels are jointly operating offices.This is not an impulse move,but a scientific option based on history,reality,political and other considerations.It is conducive to strengthening the party's leadership of disciplinary inspection and supervision,as well as integrating anti-corruption forces,expanding the scope of supervision,ensuring discipline and law convergence,and ultimately promoting the establishment of a more comprehensive anti-corruption system.Discipline Inspection Commission and Supervisory commission as One Office showing some characteristics: Firstly,adhere to the organizational principle of “a set of institutions” in the organization setting,and adjust the framework and duty of the internal organization and accredited agency;Secondly,there are “parts and cooperations” in the performance mechanism,which not only highlights the advantages of the Discipline Inspection Commission and the Supervisory Commission,but also guarantees their independence;Thirdly,pursue mutual connection in the case handling procedures,realizing the procedures through clues disposal,case filing and trial.However,although under the background of the reform of the supervision system,the Discipline Inspection Commission and Supervision Commission has formed some experience on the basis of practice,but there are still some shortcomings.At the institutional system level,whether it is the supervision legal system or related intra-party regulations,they need to be revised or formulated in a timely manneraccording to practical needs.For example,the joint issued by the party and government needs further standardization,and the supporting laws of the Supervision Law need to be improved.On the organizational system,although the internal institutions and the resident agencies have been improved based on the principle of "a set of institutions",the relationship and responsibilities between the institutions still need to be further clarified.In the case handling procedures,there are some problems in the publication of standards,the connection of examination and investigation,and the connection of trials,which need to be further improved.In the supervision of Discipline Inspection Commission and Supervisory Commission,there are two questions: In the internal supervision,the role of self supervision department is not fully played.At the same time,the supervision form of the superior Discipline Inspection Commission and the superior Supervision Commission does not match;In the external supervision,It is high time to strengthen the inspection and supervision of the superior party committee.At the mean time,we should clarify the boundary between the Party committee supervision at the same level and National People's Congress and its Standing Committee supervision at the same level in terms of the supervision's content and form.Based on this,we will propose optimization measures according to the problems to be solved by the Discipline Inspection Commission and Supervisory Commission Office: the first is to improve and perfect the institutional system;the second is form a comprehensive and clear the organizational system;the third is to establish an integrated and orderly operating mechanism;the fourth is to build a strong and powerful supervision system.
