With the wide application of technology and the Internet, the Internet as aplatform for online rental software approach are rising, market demand is growing, inthe traditional software licensing model, most of the laws and regulations made onlyfor the tangible works specified rights.For electronic rental model, the traditional software licensing model is notsufficient to regulate this new behavior, such as the traditional rights of rental relysolely on existing core network elements can not be defined as a virtual leased rental,which gives today’s copyright system an enormous challenge and can be includedrental rights protection areas, different scholars have different views.Through comprehensive comparison study of online rental software under theSaaS model, through literature references, comprehensive induction, comparativeanalysis and other methods, the system of rental rights regime under the SaaS modelwere summarized and analyzed, the article is divided into a total of four blocks: Thefirst part describes the background of the wording of this article, and a briefintroduction of the research status;the second part introduces the basic concepts ofrental rights and the basic theory of SaaS and SaaS mode; the third part introducesthe application of SaaS, and summarizes the advantages obtained under the SaaSmodel and its theoretical basis applicable rental rights regime; thr part IV discussesthe feasibility analysis of the SaaS model and remodeling rental rights system,andgive the legislative proposals.In summary, in an era of rapid technological development and wideapplication of the Internet, in order to adapt this new economic model, improvingrental rights laws and policies, strengthening supervision, building a soundintellectual property protection system, has become an inevitable trend.
