Research On The Copyright Protection Of Computer Software Under The SaaS Mode

Cloud computing,as the third wave of IT, has a significant impact on the computer software copyright system. As the most representative of the cloud computing service model, the SaaS model has not only dramatically changed the way of using software, but also brought serious challenges to the protection of software copyright interests. Under SaaS mode, users can use the software at anytime to access to the relevant server through the Internet without getting the originals or copies of software. In the existing software copyright property rights, whether the reproduction right, the network dissemination of information right or the rental right, it is difficult to fully cover the software use behavior under this model. In recent years, the domestic scholars have started to study the problem of the copyright protection of the computer software under the SaaS mode, and it has made certain progress, but it did not form the theoretical results of the system all the same. Therefore, it is necessary to learn copyright protection system from Europe, the United States and other developed countries to adjust and perfect the reproduction right, the network dissemination of information right and the rental right under the SaaS mode in our country. In order to protect the interests of copyright owners, to protect the public's reasonable use of software and to promote the development of the SaaS model software industry, it is necessary to admit "temporary copy" and "electronic rent", and to define the scope of "access these works" in the network dissemination of information right.
