| In order to maintain economic and technological supremacy, The United States ofAmerica make every attempt to suppress our enhancing trade competitiveness and impactto the existing international market, by promoting the protection of internationalintellectual property, raising protection standards, and expanding the scope of protection.In1990, taking advantage of the regulations of "Customs Law", article337th, The UnitedStates of America frequently made trade friction to Chinese manufacturing enterprises inthe fields of intellectual property rights protection, and set obstacles for our mainlandenterprises to exploit international market. Furthermore, there were many difficulties forChinese enterprises in responding to the337survey, which caused an enormous andpainful price paid by our enterprises. Therefore, it has important meaning and value tostudy the strategy on intellectual property for the United States337terms to Chinese tradebarriers.Firstly, this paper briefly describes the research background and significance of thetopic, and then introduces the main contents and operation mechanism of the United States337, analyzes legislative intent of the United States337provisions. Afterward, combiningwith the objective facts of cases, data, direct and indirect loss of our country enterprise,the author expounds the existing problems and unfavorable factors, and carries on ananalysis to the current situation of our enterprises and influence caused by the UnitedStates337investigation, and analyzes the internal and external reason of our countryfacing337Survey. Then, according to the other countries’ experiences and China’scurrent condition, the countermeasures provided by the author put forward thecorresponding suggestions in responding to the American337investigation from differentaspects to improve the intellectual property rights in China, and indicate principles andstrategies of China should grasp in responding to the337Investigation. |
