Research On Administrative Law Enforcement And Criminal Justice Cohesive Mechanism

How to implement the administrative law enforcement and criminal justice ofcohesion, has Always been the important problem of legal practice in our country. Basedon the institutional environment and practical difficulties found after investigation，tosolve this problem fundamentally, we must focus on establishing the cohesive mechanism,not only to perfect the legislation, but also should build perfect administrative illegal casesof alleged transfer procedures, criminal judicial authority to transfer the case handlers andadministrative law enforcement agencies to collect evidence system of cohesion andconversion procedures, etc. In addition, we still should improve the administrative lawenforcement and criminal justice bridging program related supporting system, such as thecohesion and improve the information sharing mechanism, joint meeting system, andgives the power of procuratorial organ involvement in advance, establish strongcoordination case is transferred for the department in charge of the work, and so on.The article is divided into five parts: the first part is problem is put forward, mainlynarrates the background and research significance of topic selection, for the rest of thepaper puts forward a tantrum. The second part is about the theoretical basis ofadministrative law enforcement and criminal justice cohesion analysis, mainly through tothe rule of law theory and the theory of function division of labor, mutual cooperation,establish the article discusses legal basis. The third part is the cohesion of dilemma ofadministrative law enforcement and criminal justice. This part of the paper mainlypresented the current problems existing in the practice, both cohesion and disadvantages.The fourth part is the link of the administrative law enforcement and criminal justice deepreason analysis. This part mainly analyzes the theory and practice of administrativepenalty and punishment of fracture, modern excessive expansion of executive power andthe society as a whole system partly due to the influence of background and legalenvironment. The fifth part analyzes the cohesive mechanism how to perfect theadministrative law enforcement and criminal justice, including perfecting legislation, theapplication mechanism and relevant supporting system.
