The Legal Measures Against Group Petition Emergency

Recently, the group petition emergency is increasing gradually, even showing atrend of high, which has been an important factor that impacts on social stability. Atpresent, people pay more and more attention to handle the group petition emergencyand put it into practice gradually, but according to the content and theory of legalmeasures against group petition emergency, the legal response system hasn’t beenformed in China, which is harmful to prevent and deal with the group petitionemergency. Therefore, this thesis puts forward the opinion that we should establishand improve the legal measures system against group petition emergencyimmediately.According to the above point of view, this thesis is divided into four parts, its maincontents as follows:ChapterⅠ, this thesis reveals the reasons of group petition emergency, such asunfair distribution of benefits, corruption, more consciousness of law, channels ofinterest demands blocked, and so on. The current events have the feature of transitionbecause of our special conditions. Then, this thesis describes composition of legalsystem of group petition emergency, including petition working system, petitionprevention system and petition treatment system. The value orientation of legalmeasures against group petition emergency is to maintain social stability andsafeguard people’s interests. At last, this thesis talks about the basic principles of legalmeasures against group petition emergency.ChapterⅡ, the thesis analyzes the status quo of legal measures against grouppetition emergency in China. By studying the provision of Regulation ConcerningLetters of Petition The People’s Republic of China Emergency Response Law andsome other laws, I find out some problems in our legal system, including legislativedefect, enforcement defect, putting the cart before the horse and the lag of education.ChapterⅢ, this thesis emphasizes the necessary of establishing and improvinglegal measures against group petition emergency. Through the establishment andimprovement of legal measures against group petition emergency, we can strengthensocial safety and stability and resolve the defect of relevant legal systems in ourcountry. Chapter Ⅳ, this thesis proposes to strengthen the establishment of group petitionemergency legal system. At the present stage, we must put prevention first and insistcorrect countermeasures in terms of prevention, defusing, control, right remedy andaccountability system. We should enact proper laws to handle the group petitionemergency.
