| China is in a key stage of deepening reforms currently. Due to the constant changes of social structure, all kinds of unbalanced phenomenon, uneven distribution of social resources, urban and rural differences, the gap between the rich and the poor, are always growing. As citizens’ rights awareness continues to increase, the problems triggered by corporate restructuring, land acquisition and reallocation, the appeals of rights, illegal fund-raising, medical disputes, housing disputes, etc, are increasing within the prominent contradictions among the people. Issues like these, would cause mass petitions once improper handled, and even traffics blocking in the government agencies.Petition is a welfare of citizens, if the solution is not appropriate or in time, on the one hand, it will affect people’s trust to the party and the government, on the other hand, it will seriously affect the normal working order of the party and government, and bring many problems against the social stability. How to ensure the interests of the people to be protected and promote the petition work standardization, institutionalization, and legal construction simultaneously, has become the urgently in need of party and the government.Based on the extensive mining of the existing petition systems and on-the-spot investigations, this study focus on the current situations of the mass collective petition in S Province, using the theory of rule of law, the theory of administrative remedy, the game theory and the social conflict theory. This study systematically analyzed the evolution of petition in China, and performed statistical analyses of the mass collective petition in S province from 2010 to 2015. The petition in China are summed up the six groups, including social security, corporate restructuring, land acquisition and relocation, illegal fund-raising, housing dispute, and the rest. The author found that the massive petitions in S province is highly organized, and behavior become more extremely, with a variety of appeals. Some of the laws, working procedures, handlings, and the feedbacks are still need to improve. The author also found three reasons for the mass collective petition, including shortens in social and economical environments, policy and regulation system itself, as well as the working mechanism. Base on these findings, the author suggested four approaches to enhance current petition working mechanism in S province, that is, to improve laws and regulations, standardize the behavior of letters and visits; to combine and merge some rule of law, for solving the problem of collective petition; to invent the new idea of the petition to innovate the working mechanism; insist to solve the problem from the source, and deal with the conflicts actively. |
