Recent years, with the acceleration of urbanization, people’s living standard hasrisen gradually, private cars are becoming one part of home consumption, which isfollowed by some parking problems: unreasonable price of the parking lots, parkinglots only for sale without being rent, parking fees overcharging the standard and so on.The reasons for these disputes are: unclear property rights, unreasonable pricingpower, the lack of regulation related to this area and so on. Settling these disputes isbenefit for us, because not only the legitimate rights and interests of the propertyowners can be satisfied and communities can be harmony, but also the motor industryin China can be influenced. Therefore, after having comprehensive analysis of thepricing system of the residential community, the author put forward an newassumption on the parking pricing mechanism: The pricing power should base on thegovernment guiding price but can be distinct according to different market situation.This paper is divided into five chapters, based on the price dispute of the parkinglot in residential community, starting from the property rights of the parking lot andthe rights of the price-parties,it analyzes the related laws and regulations on theexisting parking lot in residential area and parking pricing system,and put forward theauthor’s assumption on pricing rights system.The first chapter is the introduction to this article, the topic of this article hasbeen brought in by introducing the two typical cases about the parking lots in theresidential district,.Introduces some definitions related with the topic and theirmeaning, sort out three different price-parties: the government, real estate developers,realty management companies.Chapter II the formation and development of three different pricing power is thefocus in this part. As the housing market in China has not developed into marketingsystem for a long time, the private car industry only has a short period.Therefore,the various laws and regulations of the pricing power are insufficient and incomplete. The third chapter analyze the pricing dispute from different dimensions. First,the defects and deficiencies of the laws and regulations has left the price of parkingdispute a "hint"; Secondly, since the "property rights are the foundation of all therules",in this part, it takes more to talk about the different ownership of parkingspaces, trying to rationalize the property rights to solve the pricing problem. Finally,reveals the reasons for the parking disputes between property management companiesand property owners: the vague property of parking charges.Chapter IV points out that the price of the parking lots in the residence communityshould be regulated. According to the first three chapters of analysis, the dispersedpricing system has led to lots of disadvantages.Based on the related theories "marketfailure theory; price theory; theory of public interest; scientific outlook ondevelopment theory", it is necessary to adjust the pricing system.Chapter V presents some proposals on pricing power, it suggests that the pricingpower of the developer in the residential area will be into the range of guidance priceof the government,. Strengthen the participation of owners and supervise the rights ofparking pricing, improve the system of price information, increase the effectivesupply of parking spaces and reduce the possibility of monopolistic pricing, thusreducing the price of parking disputes.
