Through investigating and researching the auto license limit policies issued inShanghai, Beijing, Guiyang, Guangzhou and Tianjin, this dissertation is intend toanalyze the legality of making local administration regulations to adjust publicresource on the premise of protecting public interest. The dissertation emphasizeswhen all levels of government in our country exercise public power and makepolicies, regulations and normative documents, they must ensure that there arelaws to abide by, the laws are strictly observed and Enforced and thelaw-breakers will be punished. The government power should be confined legallyto limit public power magnification and abusing, and protect the legal rights ofcitizens are not violated. After analyzing in detail, this dissertation believe thatboth the contents and forms of the auto license limit policies brought about lots ofnegative demonstration effects. The making process of the policies did not conformto the legal procedures, the implementing effect of policies give rise to newinequality, and in the respect of interest consideration, serious imbalance of legalinterest is obvious. Therefore, the dissertation advocates to annul the existing autolicense limit policies, suggesting to take more reasonable and practicablealternative measures to solve the traffic jam problems, and the concrete measuresinclude implementing traffic control, developing urban public transportation,extending city road system, and advocating low carbon travel, etc.
