The Research On The Negotiation Of The Unified Deliberation In Local Legislative Procedure

The negotiation of the local legislatures’ unified deliberation is amechanism that based on the deliberation opinions of the other committee,the standing committee of the local People’s Congress and other variousopinions collected, aiming at the unification of the legal system andelimination of unjust interests, the members of the law committee and otherparticipants who are invited to reach the consensus through equal means ofdialogue, debate and concession in the process of the unified deliberation oncertain draft regulation. From the aspect of value, to the legislative procedure,the negotiation has own value and instrumental value as well. From theaspect of function, the negotiation contributes to improve the quality oflegislations.In laws and some local regulations, there are some provisions related toguarantee the negotiation of unified deliberation, including attendance, explanation of reject decision on important advices and the differencesmanagement. By text analysis on the report of the local unified deliberation,on certain extent, system deficiency is existence and the degree of negotiationis limited.As a result, it is necessary to transform the concept of legislativeprocedure and to definite the principles of negotiation. To create the externalsystem by the means of openness and broadening the range of participants.To strengthen the internal system by perfecting the attendance stipulation andopinions management, implementing the method of one discussion for onecase, embedding the mechanism of debate, regulating the reporting systemand differences management.
