On The Perfection Of Local Legislative Procedure

The construction of legitimate legal procedure through institution is human being's rational selection. In our traditional juristical culture, the drawback that the substantive law has been attached more importance to than legal procedure has been all through the ages, and the design and application of the legal procedure has been received little attention. With the advocacy of the national policy of administering a country according to law, our jurisprudential theoretical circle and substantial circle pay more and more attention to legal procedure. But, the legislative procedure has not been looked into thoroughly; the good qualities of democracy, openness, negotiation and autonomic discipline that the modern legal procedure is due to have have not been paid enough attention to. So the construction of democratic, just, scientific legislative procedure has realistic significance to improve the quality of our local legislation, to advance the progress of our democracy and legal institution. Combining the theoretical research results and the practice of our local legislation,standing on the practical feasibility, the author promotes the concretedesign and the conceived idea of the local legislative procedure, which lays special attention on the structure and the value of the legislative procedure.The structure of the thesis is that: firstly, from the general theory of the legal procedure, I analyze the legislative procedure and the property and the value selection of the local legislative procedure; Secondly, I analyze the general procedure of the local legislation and the four links of the local legislation: the advocacy, the consul, the vote and the promulgation; thirdly, I analyze the weak points in the procedure of local legislation, basing on the requirement and the practice of the local legislative procedure from our laws and regulations; lastly, I advocate some ideas to perfect our local legislative procedure.
