Internet technology promotes the development of the electronicbusiness; the third party payment develops subsequently, which at thesame time facilitates the booming of E-business. The third party paymenton Internet, representing by Internet payment and mobile payment,occupies an important position among the third party payment area. Atthe same time, the third party Internet payment has influenced the societydeeply. But on the other side, the third party Internet payment regulationand legislation cannot keep up with the development of it, and even farbehind the development of the former. This hysteresis obviously willinfluence further development of the third party payment and increase thedealing and managing cost. This paper starts from the history of the thirdparty payment, then analyzes the advantage and disadvantage of the thirdparty payment on Internet, analyzes the legal issues among this area, andat last, to obtain a better development environment of the third partypayment on Internet, the author puts forward her own suggestions from supervising and legislation’s side.There are totally three parts in this paper: the first part introduces thehistory, general character and function of the third party payment onInternet,and analyzes the advantage and disadvantage; then estimates itsdeveloping direction; The second part analyzes related law relationshipsof the third party payment on Internet and makes clear the legal propertyof it,then discusses main three problems: the unclear border of lawresponsibily; the owner shipment of the precipitation funds and the yield;the inefficient supervise to the third party payment on Internet. The thirdpart gives detailed analysis of the main three problems of the part two andputs forward suggestions regards to the above three problems.
