Illegal construction is defined as buildings that violate-the lawdocuments of the Land Use Management, Urban and Rural Planning,Construction Order Management. In real right, there are different viewson whether the builder of the illegal construction owns the real right, andif the right is ownership right, incomplete property right or real propertyownership. The author thinks it cannot simply conclude the illegalconstruction is rigidly denied for their ownership. Illegal constructionshould hold the real property ownership.Firstly, this research will introduce the present state of illegalconstruction. After that, different viewpoints on the nature of the realright of illegal construction will be analyzed; meanwhile, the nature of thereal right of illegal construction and the practical value of the ownershipof illegal construction will be analyzed and interpreted to prove thatillegal construction should hold the ownership of the real property.Moreover, the faulty points of the nature, regulation and law of illegalconstruction will be analyzed further in order to concluderecommendations for completing relevant legislations and regulations.The purpose of this research is to provide useful suggestions for dealingwith the nature, punishment and judicial practice in relation to illegalconstruction.
