In recent years, the non-standardized labor relationship got rapid development inour country, various types of non-standardized labor relationship have producedgradually, the working field of non-standardized laborers got wider. However, thenon-standardized laborers has been disadvantaged in the labor market, the quality ofemployment is lower than standardized laborers; several typical types ofnon-standardized labor relationship is not incorporated into the guarantee system oflabor law, non-standardized laborers is lack of effective legal protection, and thesocial benefit and justice can not be achieved.With these problems, this thesis defined non-standardized labor relationship under thedirection of domestic and international research results; in the perspective of laborrights, it introduced the main problems in the legal protection of non-standardizedlaborers in the non-standardized labor relationship, and proposed some suggestions.The thesis can be divided to four chapters:Chapter One: the summary of labor rights. This chapter includes three parts: thesignificance of the definition of labor rights, the concept of labor rights and the scopeof labor rights.There are three theories of labor rights in the academic circle, thegeneralized theory, the narrow theory and the theory of human rights. This thesis usethe concept of labor rights from the perspective of human rights, and interpret thescope of the labor rights.Chapter Two: the summary of non-standardized labor relationship. Firstly, thischapter have interpreted the concept and features of non-standardized laborrelationship, which is in favor of the compare between standardized labor relationshipand non-standardized labor relationship. After the comparison, it comes out thefeatures of non-standardized labor relationship. Then, with the domestic andinternational research results, I can have a result of the definition of non-standardizedlabor relationship. At the last, several typical types of non-standardized laborrelationship are list.Chapter Three: the main problems in the legal protection of non-standardizedlaborers in the non-standardized labor relationship. The substance of the chapter is theinfringement to the right to work, right to rest, right to remuneration, right to workingenvironment, right to social security and solidarity right.Chapter Four: suggestions from the perspective of labor right of the legal protection of non-standardized laborers in the non-standardized labor relationship.This chapter explain the basic principles and the train of thought of the suggestions.According to the problems, it proposed some suggestions.
