The Significance Of Legality Guarantee In Social Administration Structure Construction

Since the Sixteenth session of the National People’s Congress, theCommunist Party of China made the strategic task of building a harmonioussociety. As an important component of building a harmonious society, socialmanagement is the fundamental project of building a well-off society. At present,in the process of ruling by law, governing by law, and administration accordingto law, the construction of social management system should pay more attentionto the role of law protection system. The author combed classic writers ofMarxism and the Communist Party of China’s social management thought,indicates the important status of the guarantee of ruling by law in the socialmanagement system, pointed out some solutions and suggestions based onanalyzed social management achievements and existing problems.This paper consists of four parts: part one, introduction, describes theintegration of legal guarantee of social management and social background,research status and significance. On the Eighteenth session of the NationalPeople’s Congress, it was a radical innovation that the Communist Party of Chinaput the rule of law into the social administration system, which possessedimportant theoretical and practical significance in resolving social contradictions,reducing social risk, maintaining social stability, safeguarding social fairness,justice and the vital interests of people, etc.Part two: mainly an overview of social management theory. Firstly, theauthor interpreted some concepts such as social management, social managementsystem, and social governance. Secondly, the author combed the socialadministration theories by Marxist classical writers, including revealing thevarious drawbacks coming from the capitalist society social administration andelaborating the objectives, nature and principles of communism society socialadministration theory.Thirdly, the author made a summary of social managementthought according to the CPC since the foundation of New China. Finally, theauthor discussed the social background and realistic significance from socialmanagement to social governance.Part three: on the basis of discussing through combing and analyzing theevolution of governing by law, the author pointed out that the rule of law is thesystem guarantee of the social orderly development. Meanwhile, the author analyzed the experiences, problems,reasons of social management from theaspects of education,employment, social security,etc.What is more, the authordiscussed the crucial role of legal safeguard in defining the subjects of socialmanagement responsibilities, ensuring the society within the framework, andprotecting the vital interests of people.Part four: the author discussed that the social administration systemconstruction should follow these principles: the leadership of the PartyCommittee, Government responsibility, society, public participation, the rule oflaw principle, etc. The author pointed out a series of feasible paths, for example,improving the way of social governance, activating social organization,innovative and effective mechanism in order to prevent and dissolve thecontradiction; realize the public self-management, self-service andself-development; improve the network virtual social management level, as wellas improving and completing the relevant laws institutions, etc.
